WARNING: Effective November 28th, 2002, Massachusetts changed its laws concerning Drunk Driving (OUI, DUI, DWI). Multiple offenses are now considered for the rest of your life. You need to speak to a lawyer to determine how this change affects you.

Attorney James M. Milligan, Jr. received a dismissal for a client charged with DUI in Massachusetts. The client was involved in a bad single car motor vehicle accident. He was quickly transported to the hospital and was eventually flown to a Boston hospital. The officer never informed him of the charges until at least 7 days later that he was going to be charged with DUI. Attorney James M. Milligan, Jr. filed a motion to dismiss the DUI charge based upon the lack of timely notice. The judge agreed and dismissed the client’s DUI case as the lack of notice prevented him from obtaining evidence that would have potentially created a defense to a DUI charge, like get a blood test performed.

Attorney James M. Milligan, Jr. received a Not Guilty for a client for a Massachusetts DUI charge where he was stopped at a DUI roadblock set up by the Massachusetts state police. The matter went to trial and at the trial it was revealed that the officer did not follow the instructions for the field sobriety tests and the client in fact passed 3 out of 4 of the field sobriety tests. The judge acquitted the client of his Massachusetts DUI charge.

Milligan, Jr. received a dismissal of a client’s Massachusetts DUI charge where the officer blocked his motor vehicle, thus preventing him from leaving because the client traveled with no headlights for 10 to 15 feet. A motion to dismiss the DUI charge was filed as the police officer lacked reasonable suspicion or probable cause to stop the motor vehicle leading to observations by the officer, which resulted in his DUI charge. The Judge agreed and dismissed the client’s Massachusetts DUI charge.
