Attorney James M. Milligan, Jr. received a dismissal of a Massachusetts drunk driving case where a client was stopped at a Massachusetts drunk driving roadblock. As a result of observations made by the officer, the client was asked to pull over and perform some field sobriety test to determine if he was under the influence of alcohol. The client performed well on the field sobriety tests but had a breath test result of a .16, twice the legal limit. The case was dismissed as a result of a motion to suppress the stop of the car based upon an invalid drunk driving roadblock.

Attorney James M. Milligan, Jr. received a not guilty for a client who was charged with a Massachusetts drunk driving as a result of a very bad single car motor vehicle accident. As a result of the accident and some brief observations made by the officer he was charged with drunk driving. The client told the officer that his dog had jumped on him making him swerve and struck a rock close to the roadway. The officer did not believe the client. However, after the client was transported to the hospital, a neighbor came over to the police officer and told him the dog was inside the motor vehicle and ran away after the accident, thus confirming the client’s account. The client was found Not Guilty of his Massachusetts drunk driving charge.
