WARNING: Effective November 28th, 2002, Massachusetts changed its laws concerning Drunk Driving (OUI, DUI, DWI). Multiple offenses are now considered for the rest of your life. You need to speak to a lawyer to determine how this change affects you.
Additionally, as of July 1st, 2003, it is a criminal offense to submit to a chemical or blood test and obtain a result of above a .08, the legal limit in Massachusetts.
Under
Massachusetts law the government must show that alcohol diminished
your client’s ability to operate a motor vehicle safely,
that is, he/she was OUI,DUI,DWI. Typically, the government
will attempt to show that your client was operating under
the influence of alcohol through the testimony of the police
officer in their administration of field sobriety tests.
